Calcutta High Court Seeks PSC’s Stand After Non-Appearance on Judicial Examination Case, Matter Listed Tomorrow Amid December 7 Exam Scheduled.
The Calcutta High Court on Tuesday, 2nd December 25,expressed concern over the absence of the Public Service Commission, West Bengal (PSCWB), in a writ petition challenging the legality of the West Bengal Judicial Service Examinations for 2023 & 2024.
The matter came up before Justice Saugata Bhattacharyya in W.P.A. 27328 of 2025, filed by Advocate Shayan Sachin Basu. The petitioner contends that the PSC’s final advertisements dated 13 August 2025 were issued in violation of paragraphs 89(vii) and 89(viii) of the Supreme Court’s judgment dated 20 May 2025 in All India Judges Association vs. Union of India, which lays down binding norms governing judicial recruitment.
Though notices were duly served & all other respondents including the State & the High Court Administration, all appeared before the Hon’ble Court, but no one from the Public Service Commission was present. Taking note of this absence, the Court directed that fresh service be issued on PSCWB so that its position can be properly placed before the Bench.
Given that the Judicial Service Examination is scheduled for 7th December 2025, the Court has decided to take up the matter again tomorrow, highlighting the urgency of obtaining the PSC’s response before the examination proceeds any further.
Legal observers note that the absence of PSCWB, despite service, assumes significance in a case where compliance with Supreme Court directives is under scrutiny. The Court is expected to examine the issue further on the next date, depending on whether PSCWB finally appears to clarify its stand!
